SMS Messaging Terms and Compliance

1. Program Description: This messaging program sends consultation and strategy session confirmations, appointment reminders, scheduling and rescheduling updates, follow-up communications, and service updates to prospective and current clients who have requested a consultation, booked a session, started a service, or otherwise explicitly opted in to receive SMS notifications from Abi Eagle Wings LLC DBA DaDigitalSense Marketing. Opt-in is collected via our web forms and booking forms, with a dedicated checkbox or clear consent language for SMS consent where required.
2. Cancellation Instructions: You can cancel the SMS service at any time. Simply text STOP to the same number that sent you messages. Upon sending STOP, we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us, except for a final confirmation message if applicable. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

4. Carrier Liability: Carriers are not liable for delayed or undelivered messages.
5. Message and Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage, appointments, and interactions with us. For questions about your text plan or data plan, contact your wireless provider.
6. Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, and Verizon, and most regional carriers.
7. Age Restriction: You must be 18 years or older to participate in our SMS program.
8. Privacy Policy: For privacy-related information, please see our Privacy Policy page. We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications. Your consent to receive text messages is not a condition of purchasing any service.

General Terms

This website (the “Site”) is owned and operated by Abi Eagle Wings LLC DBA DaDigitalSense Marketing (“DaDigitalSense,” “we,” “our,” or “us”). Services and Scope

Abi Eagle Wings LLC DBA DaDigitalSense Marketing is a marketing agency for holistic, and integrative medicine practitioners, including massage therapists, hypnotherapists, energy healers, chiropractors, holistic spas, functional medicine practices, and other integrative wellness practices. Our services may include visibility and gap assessments, strategy, Google Business Profile optimization, local search optimization, websites, funnels, content and social media, booking and calendar setup, and ongoing monthly optimization and check-ins, as described in your applicable order, proposal, or agreement.

Our published packages are the Visibility Starter Kit, the Visibility Accelerator, and the Market Dominator. Our packages require a 6-month commitment. After that initial period, the agreement is month-to-month, and you may cancel with 30 days’ notice. The specific services, features, deliverables, and fees for your account are those described in your applicable order, proposal, or agreement.

We do not guarantee any specific ranking, traffic, lead, or revenue result. Marketing results depend on many factors outside our control, including your market, competition, and participation. We report progress through the monthly check-ins described in your agreement.

Abi Eagle Wings LLC DBA DaDigitalSense Marketing is a marketing agency, not a healthcare provider, and does not provide medical care, diagnosis, or treatment. Nothing on the Site or in our services is medical advice.

Client Responsibilities

• Provide accurate business information, including hours, service areas, services offered, and booking rules, and keep it updated.
• Provide and maintain the access and permissions needed for setup, which may include your website, Google Business Profile, and social accounts, and keep your account credentials secure.
• Make sure you have the consent and legal right to contact every lead and customer you ask us to message, and to share their information with us for that purpose.
• Review deliverables, content, and listings we prepare, and tell us promptly about errors or changes.
• Comply with all laws that apply to your practice, including telephone, text messaging, privacy, and advertising laws.

Acceptable Use

• Do not use the services to send spam, unlawful, deceptive, or harassing communications, or to contact people who have opted out.
• Do not upload or process information you do not have the right to use.
• Do not attempt to access another account, disrupt the platform, or misuse the services.

Fees and Payment

Fees, package contents, timelines, and any guarantee, if offered, are as stated in the applicable order, proposal, or agreement. Payment is due as stated in that agreement. If payment fails or is overdue, we may pause services until payment is made, after notice to you.

Intellectual Property

The Site and all materials available on the Site are the property of Abi Eagle Wings LLC DBA DaDigitalSense Marketing and/or its licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal, non-commercial use, except as agreed in writing.

Materials you provide to us, including your business name, logos, photos, and content, remain yours. You grant us a license to use them solely to deliver the services you ordered, including publishing them on your website, listings, and marketing channels as agreed.

Confidentiality

Each party will protect the other party’s non-public information and use it only for this relationship. Our handling of personal information is described in our Privacy Policy. Lead and customer information processed through funnels, forms, or calendars we manage for you is processed on your behalf and under your instructions, subject to our providers’ terms.

Disclaimers

The services and website are provided as is and as available, to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted service, because the services rely on the internet and third-party platforms outside our control.

Limitation of Liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or lost-profit damages. Our total liability for claims connected with the services will not exceed the amounts you paid us for the services that gave rise to the claim during the three months before the claim arose, except where the law does not allow such a limit.

Indemnification

You agree to indemnify and hold Abi Eagle Wings LLC DBA DaDigitalSense Marketing harmless from claims, damages, and expenses arising from your business services, your instructions, your customer communications and consent records, your violation of law, or your misuse of the services. We agree to indemnify you from third-party claims that the services, as we provided them, infringe that party’s intellectual property rights.

Term and Termination

These Terms apply while you use the website or services. Either party may end the service relationship as provided in the applicable order or agreement. Sections on fees owed, intellectual property, confidentiality, disclaimers, liability, indemnification, and governing law survive termination. On termination we will make your business records in our systems available or delete them as described in the Privacy Policy and your order.

Governing Law and Disputes

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration in Colorado.

Changes to Terms of Service

We may update these Terms of Service from time to time. The latest version will always be available on our website with the effective date.
